A number of Hong Kong media including The Sun Daily, Sing Tao Daily, Oriental Daily, and others reported that some domestic helpers in Hong Kong are colluding with domestic helper agencies and using “poor work performance” to get employers to fire them so they can receive one month pay (in lieu of notice). The helpers will then look for another employer with the help of the agencies so that the agencies can earn fees from more employers. Helpers are usually promised a share of the agency fees received.

The news report quoted Ms. Yau as saying that her previous Filipino helper had refused to do work only after one day of getting hired. After two weeks, the helper fabricated stories about being locked up in a room by the employer and in the end, Ms. Yau had to agree to terminate the contract and pay the helper the one month notice pay and a flight ticket in addition to the HK$19,000 in agency fees.

The Hong Kong Foreign Domestic Helpers Watch Group said that one in five employers had been in a similar situation where employers are forced to terminate the contract due to “non-performance” of the helpers hired and pay both one month notice pay and the expensive agency fees. These helpers are encouraged by agencies to “refuse to do anything and in some cases, deliberately injure their children or break things” so that employers will be forced to fire them.

According to the news report, some of these helpers will head to Macau or other countries if they are unable to look for another employer in Hong Kong.
